Terms of service

These terms explain what you can expect from OmniLead, what we expect from you, and how billing, data and termination work.
1. The agreement
These terms are an agreement between you (or the organisation you represent) and CloudGens (“we”, “us”), which operates OmniLead at omni.cloudgens.net. By creating an account or using OmniLead you accept these terms, our Acceptable use policy and, where it applies, our Data processing addendum. If you accept for an organisation, you confirm you have authority to bind it.
2. Accounts
- You must be at least 18 and use OmniLead for business or professional purposes, not personal or household ones.
- Keep your login details secure. You're responsible for activity in your workspace, including by teammates you invite.
- Give us accurate account and billing information and keep it current.
- We may refuse sign-ups from disposable email addresses or where we reasonably suspect abuse.
3. Using OmniLead
We grant you a non-exclusive, non-transferable right to use OmniLead during your subscription, within your plan's limits. You won't resell or sublicense access except as your Agency plan allows (for example, white-label reports for your own clients), reverse engineer the service, bypass rate limits, credits or security controls, or scrape or bulk-copy OmniLead data outside the export features we provide.
4. Data and content
Your data
You own the data you add to OmniLead, including imported contacts, notes, emails and pipelines (“Customer Data”). You give us permission to host, process and display it only to provide and support the service. When we process personal data in Customer Data, we act as your processor under the DPA.
OmniLead data
Search results come from public sources such as SEC EDGAR, Grants.gov, NIH RePORTER, NSF Awards, OpenAlex, ORCID, Crossref and public websites. Each field shows its source and the date we found it. We don't guarantee that public sources are accurate or complete. Once you reveal a contact, you may use it within your workspace and export it under these terms, subject to any removal or suppression request we receive from the person concerned.
Removal requests
People can remove or suppress their data through our opt-out portal. Removal applies across all workspaces, including contacts you have already revealed, and suppressed addresses can't be emailed from OmniLead.
5. Plans, credits and billing
- Paid plans renew automatically each month or year until cancelled. Prices are shown on our pricing page and exclude taxes, which Stripe calculates at checkout.
- Credits are used for search pages and reveals. Monthly plan credits don't roll over. Credit packs never expire while your account is open. Credits have no cash value.
- Revealing the same contact again is free, and failed or invalid lookups are refunded as credits automatically.
- The Growth trial lasts 14 days, needs no card, and moves your workspace to the Free plan when it ends unless you choose a paid plan.
- You can cancel at any time in Billing. Your plan stays active until the end of the paid period. Except where the law requires, payments are non-refundable.
- If a payment fails we'll retry and notify you. If it still fails, we may move your workspace to the Free plan.
6. Your compliance duties
You're responsible for how you use OmniLead, including the emails you send. You'll comply with the laws that apply to you and your recipients, such as CAN-SPAM, the GDPR and UK GDPR, the ePrivacy rules of each country, and Canada's CASL. OmniLead's safeguards (unsubscribe headers, postal-address checks, suppression and per-country rules) help, but they don't replace your own judgement or legal advice. You'll keep a lawful basis for processing the personal data you use and honour opt-out requests.
7. Availability and changes
We work to keep OmniLead available and secure but don't promise uninterrupted service. Third-party sources may change or become unavailable; when they do, OmniLead shows no data rather than stale or estimated data. We may change features. If a change materially reduces a paid feature you rely on, we'll tell you in advance and you may cancel with a prorated refund of prepaid fees.
8. Suspension and termination
We may suspend or terminate your access, with notice where practical, if you breach these terms or the Acceptable use policy, if your sending causes spam complaints or bounce rates that threaten deliverability for others, if required by law, or if you don't pay. You can close your account at any time. After termination you can export your Customer Data for 30 days, after which we delete it as described in our Privacy policy.
9. Disclaimers
OmniLead is provided “as is”. To the extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement. Verification results are probabilities, not guarantees that a message will be delivered.
10. Limitation of liability
To the extent the law allows, neither party is liable for indirect, incidental, special or consequential damages, or for lost profits or revenue. Each party's total liability under these terms is limited to the amounts you paid us in the 12 months before the event giving rise to the claim. These limits don't apply to your payment obligations, breaches of the Acceptable use policy, or liability that can't be limited by law.
11. General
We may update these terms. For material changes we'll give at least 30 days' notice by email or in the app. These terms are governed by the laws of the jurisdiction where CloudGens is established, without regard to conflict-of-laws rules.
